FREEHOLD
Freehold describes the exclusive ownership of a property - this is the traditional method of transfer of property in Jersey.
The property is conveyed by way of a contract passed before the Royal Court. Since November 2006 all contracts have been written in English and in the case and generally contain:
- a description of the property and its boundaries;
- the clauses affecting the property;
- any new clauses which may agreed in the deed with a Vendor retaining land or where new boundaries are agreed with a neighbour.
- the title to the property;
- the consideration paid for the property;
- you will have no right of redress against the previous owner;
- An apportionment clause concerning rates.
Stamp duty is payable on the purchase of a property and we are able to provide you with a calculation as to Stamp duty at the current rates.
